ORDINANCE NO. 20-04
AN ORDINANCE FOR THE PURPOSE OF PROHIBITING THE STORING OF ABANDONED PROPERTY WITHIN THE CITY OF CAMMAGE VILLAGE, REGULATING THE PARKING OF CERTAIN VEHICLES, MOTOR HOMES, RECREATIONAL VEHICLES, BOATS, TRAILERS AND/OR OTHER VEHICLES ON WHEELS AS DEFINED BELOW IN THE CITY OF CAMMACK VILLAGE
WHEREAS, the City from time to time experiences certain problems with: (i) abandoned property; and (ii) the parking of certain types of vehicles within the City (either on the street and/or on a resident’s driveway and/or yard) which detract from the safety, tranquility and aesthetics thereof of the City; and
WHEREAS, the abandonment of said property and/or the parking of abandoned motor vehicles, motor homes, recreational vehicles, trailers, over-the-road tractor trailer rigs and/or boats that are on a trailer that occurs on the streets and/or driveways of Cammack Village, constitutes an attractive nuisance for children and may possibly cause injuries if said activities are not corrected; and
WHEREAS, the City desires to address these issues by completely replacing Ordinances
95-13, 95-17, 96-5 and 07-06 with this Ordinance 20-04 to correct these problems.
NOW, THEREFORE, IT IS HEREBY AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAMMACK VILLAGE, ARKANSAS.
Section 1: For purposes of this Ordinance: (a) an “abandoned motor vehicle” is defined as one that is in a state of disrepair and incapable of being moved under its own power and/or does not have a current safety inspection sticker and/or license plate and/or state registration number, and includes, but is not limited to, automobiles, all-terrain vehicles, boats, mobile homes or other personal property designed to be moved on wheels from place to place; (b) “open storage” is defined to include a carport which has at least two open sides; (c) “vehicle” is defined as motor home, recreational vehicle, boat, trailer, over-the-road tractor trailer rig (be it the tractor or the trailer or both), mobile home or any other personal property that is designed to be moved on wheels from one location to another (including any boat that needs a trailer in order for said boat to be moved from place to place), but shall specifically exclude golf carts; “person” shall include the occupant or occupants, owner or renter of any vehicle or personal property described in this Ordinance.
Section 2: It shall be unlawful for any person to utilize the premises of his or her property and/or vacant lot for the open storage of any abandoned automobile, motor vehicle, vehicle, ice box, refrigerator, stove, glass, building material, rock or dirt piles (not actively being used for landscaping), building rubbish or similar items. It shall be the duty and responsibility of every such owner or resident to keep the premises of such property clean and to remove from the premises all such abandoned items as listed above.
Section 3: It shall be unlawful for any person to park, situate on the streets of the City of Cammack Village or park in a private driveway and/or yard any vehicle (as defined in Section 1) for a period longer than seventy-two hours, unless it is located twenty-five (25) feet from the street curb. For purposes of this Ordinance, the seventy-two-hour window in this Section is intended to allow for temporary parking during active use of the personal property by the owner and is not intended to allow for long-term parking in multiple seventy-two-hour windows. Any person needing to park the vehicle for longer than seventy-two hours may obtain a permit from City Hall, but in no event shall a permit allow for parking in excess of one week at any one time or one week cumulative in any month. Any person seeking a permit(s) to the extent it renders this Section meaningless to the owner will be denied a permit.
Section 4: Any person convicted of violating the provisions of this Ordinance shall be deemed guilty of a misdemeanor and shall be fined not less than $50.00 nor more than $100.00 per day. Each day that the vehicle prohibited by this Ordinance is parked or situated on the streets of the City of Cammack Village shall be a separate violation of this Ordinance.
Section 5: This Ordinance repeals any other prior ordinance to the extent such other
Ordinance is in conflict with this Ordinance as to any part.
Section 6: The City Council for the City of Cammack Village finds and determines that it is appropriate to adopt Ordinance 20-04 as set forth herein as such is essential for the orderly administration and operation of the City of Cammack Village, Arkansas and an emergency is declared to exist, and this Ordinance being necessary for the preservation of the public peace, health and safety be in full force and effect on and after December , 2020.
